These Terms of Service (“Terms”) govern your use of the Caladan application (“App”) provided by SpiceFlow AI, Inc. (“SpiceFlow”, “we”, “us”, or “our”). By using our App, you agree to these Terms.

1. Acceptance of Terms

By downloading, installing, or using Caladan, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our App.

2. Service Description

Caladan is an AI-powered image transformation application that allows users to apply various artistic styles and effects to their images using artificial intelligence models. The service operates on a credit-based system where users purchase credits to perform transformations.

3. Account Registration

  • • You may create an account using Apple Sign-In or Google Sign-In
  • • You are responsible for maintaining the confidentiality of your account
  • • You must provide accurate and complete information
  • • You must be at least 13 years old to use our services
  • • One person or legal entity may maintain only one account

4. Credits and Payments

Credit System

  • • Credits are required to perform image transformations
  • • Credits do not expire and are non-refundable
  • • Credit prices and packages may change at any time
  • • Different transformations may require different amounts of credits

Purchases

  • • All purchases are final and non-refundable
  • • Payments are processed through Apple App Store or Google Play Store
  • • You agree to pay all charges incurred in connection with your purchases
  • • Pricing is subject to change without notice

5. User Content

Your Content

You retain all rights to the images you upload to Caladan (“User Content”). By uploading content, you grant us a limited license to:

  • • Process your images through our AI models
  • • Store your images temporarily for processing
  • • Create transformed versions of your images
  • • Display your content back to you

Content Restrictions

You agree not to upload content that:

  • • Violates any laws or regulations
  • • Infringes on intellectual property rights
  • • Contains explicit, offensive, or harmful material
  • • Contains personal information of others without consent
  • • Is fraudulent, deceptive, or misleading

6. Generated Content

Images generated or transformed using Caladan (“Generated Content”):

  • • Are provided to you under a license for personal and commercial use
  • • May not be used for illegal, harmful, or deceptive purposes
  • • Should not be represented as human-created when they are AI-generated
  • • May be subject to the terms of the underlying AI models used

7. Prohibited Uses

You agree not to:

  • • Use the App for any illegal or unauthorized purpose
  • • Attempt to bypass any credit or payment systems
  • • Reverse engineer, decompile, or disassemble the App
  • • Use automated systems or bots to access the App
  • • Interfere with or disrupt the App or servers
  • • Impersonate any person or entity
  • • Sell, trade, or transfer your account to another person
  • • Use the App to generate inappropriate or harmful content

8. Intellectual Property

The App and its original content (excluding User Content and Generated Content), features, and functionality are owned by SpiceFlow AI, Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. Privacy

Your use of the App is also governed by our Privacy Policy, which can be found at https://caladanapp.com/privacy

10. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • • Merchantability, fitness for a particular purpose, or non-infringement
  • • That the App will be uninterrupted, secure, or error-free
  • • That results will meet your expectations
  • • That any errors will be corrected

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPICEFLOW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

In no event shall SpiceFlow's total liability exceed the amount you paid to us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless SpiceFlow and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App or violation of these Terms.

13. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately. Unused credits are non-refundable.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the “Last Updated” date. Your continued use of the App after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of San Francisco County, California.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

17. Entire Agreement

These Terms constitute the entire agreement between you and SpiceFlow regarding the use of the App, superseding any prior agreements between you and SpiceFlow relating to the App.
